These Website Terms of Use (“Terms”) govern your access to and use of the Computers Unleashed website at unleashed.com.au (the “Site”). The Site is operated by Computers Unleashed Pty Ltd (“Computers Unleashed”, “we”, “us”, or “our”).
Please read these Terms carefully before using the Site. These Terms apply to your visit to and use of the Site, as well as to any feedback or enquiry you submit to us through the Site. They do not govern any service engagement you may enter into with us — those engagements are subject to a separate written agreement.
1. Acceptance of These Terms
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you must not use the Site.
If you are accessing the Site on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Information Only — No Professional Advice
The content on the Site — including service descriptions, blog articles, guides, checklists, and any examples or commentary — is provided for general information purposes only. It is not professional advice and is not a substitute for advice from a qualified professional that is tailored to your specific circumstances.
In particular, content on the Site does not constitute legal, financial, accounting, tax, regulatory, cyber security, IT engineering, privacy, or any other form of professional advice. Statistics, benchmarks, cost estimates, regulatory references, and forecasts are illustrative only and may be out of date or inapplicable to your situation.
Before acting on anything you read on the Site, you should obtain specific professional advice from a suitably qualified adviser who has reviewed your circumstances. You rely on the content of the Site at your own risk.
3. No Warranty
To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranties or representations of any kind, whether express, implied, statutory, or otherwise.
Without limiting the foregoing, we do not warrant that:
The Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components; the content of the Site is accurate, complete, current, reliable, or fit for any particular purpose; any defect or error in the Site will be corrected; or that use of the Site will produce any particular result or outcome.
4. Limitation of Liability
To the maximum extent permitted by law, Computers Unleashed and its directors, officers, employees, contractors, and agents are not liable to you or any third party for any loss, damage, cost, or expense (including indirect, special, incidental, consequential, or economic loss, loss of profits, loss of business, loss of revenue, loss of data, loss of goodwill, or loss of opportunity) arising from or in connection with:
Your access to, use of, or inability to use the Site; any content of the Site, or any error, omission, or inaccuracy in that content; any reliance placed on information obtained from the Site; any unauthorised access to, alteration of, or interception of any transmission to or from the Site; any virus, malware, or other harmful component transmitted to or through the Site by any third party; any link to a third-party website, including any content on or accessed from such a website; or any act or omission of any third party.
This limitation applies whether the claim is based in contract, tort (including negligence), statute, or otherwise, and applies even if we have been advised of the possibility of such loss or damage.
Where any liability cannot be excluded by law, our total aggregate liability to you arising out of or in connection with these Terms or your use of the Site is, to the maximum extent permitted by law, limited at our option to (a) the re-supply of the relevant content or service; or (b) the cost of having the relevant content or service re-supplied. If you have not paid us anything in connection with the Site, our liability is limited to A$100.
5. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified.
Where a consumer guarantee applies and our liability for breach of that guarantee can be limited, our liability is limited to the maximum extent permitted under the Australian Consumer Law — including, where applicable, to the re-supply of the relevant services or the cost of re-supply.
6. Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless Computers Unleashed and its directors, officers, employees, contractors, and agents against all claims, demands, actions, proceedings, losses, damages, costs (including legal costs on a full indemnity basis), and expenses arising out of or in connection with:
Your breach of these Terms; your misuse of the Site; your infringement of any law, regulation, or third-party right (including intellectual property and privacy rights); or any content you submit to us through the Site.
7. Intellectual Property
All content on the Site — including text, blog articles, graphics, logos, icons, images, audio, video, layout, and underlying code — is owned by, or licensed to, Computers Unleashed and is protected by copyright, trade mark, and other intellectual property laws.
You may view and read content on the Site for your personal, non-commercial use, and may print or save a copy of individual pages where this is reasonable for that purpose. Except as expressly permitted by law (such as fair dealing for criticism, review, or research), you must not:
Copy, reproduce, republish, distribute, transmit, modify, adapt, translate, create derivative works from, sell, rent, license, or commercially exploit any content of the Site; remove, obscure, or alter any copyright, trade mark, or other proprietary notice; frame, mirror, or scrape any part of the Site; or use the Site or any content for any unlawful purpose.
The “Computers Unleashed” name, logo, and any associated branding are trade marks of Computers Unleashed Pty Ltd. You must not use them without our prior written consent.
8. Automated Access, Scraping, and AI Training
You must not, without our prior written consent, use any automated means — including robots, spiders, scrapers, crawlers, or any data-mining or extraction tool — to access, copy, monitor, or extract content from the Site, except to the extent strictly necessary for legitimate search engine indexing.
Without limiting the foregoing, you must not use any content of the Site as input to, or to train, fine-tune, evaluate, retrieve-augment, or otherwise develop any artificial intelligence model, machine learning system, large language model, or similar technology, without our prior written consent. The content of the Site is provided for human readership only.
9. Acceptable Use
When using the Site, you must not:
Use the Site in any way that breaches any applicable law or regulation, or that infringes the rights of any other person; transmit or upload any material containing viruses, malware, or other harmful or destructive code; attempt to gain unauthorised access to the Site, the server on which it is hosted, or any related system or network; interfere with, disrupt, or impose an unreasonable load on the Site or its underlying infrastructure; use the Site to send unsolicited commercial communications; impersonate any person or misrepresent your affiliation with any person or organisation; or use the Site in any way that could damage, disable, overburden, or impair the Site or our reputation.
10. User Submissions
If you submit any content to us through the Site — including via the contact form, email, or any feedback channel — you confirm that the content is your own or that you have all necessary rights to submit it, and that the content is accurate, lawful, and not misleading.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and process that content for the purposes of responding to your enquiry, providing services to you, and operating our business, subject always to our Privacy Policy.
11. Third-Party Links and Embedded Content
The Site may contain links to third-party websites, or embed third-party content (such as Google Maps, Google Fonts, or analytics scripts). These are provided for convenience only. We do not control, endorse, or take responsibility for any third-party website or content, and we are not liable for any loss or damage arising from your use of, or reliance on, any third-party website or content.
12. Privacy
Our collection, use, and handling of personal information through the Site is governed by our Privacy Policy, which forms part of these Terms.
13. Service Engagements Are Separate
These Terms govern only your access to and use of the Site. Any engagement of Computers Unleashed to provide services — including AI consultancy, cloud, development, managed services, or SMB support — is governed by a separate written agreement between you and us. In the event of any inconsistency between these Terms and that agreement in respect of the relevant services, the separate written agreement prevails.
Nothing on the Site constitutes an offer capable of acceptance, and no contract for services is formed merely by your use of the Site or your submission of an enquiry.
14. Suspension and Termination
We may, at any time and without notice, modify, suspend, or discontinue the Site or any part of it, and we may restrict or terminate your access to the Site if we reasonably consider that you have breached these Terms or used the Site in a manner that may cause harm to us or any other person.
The provisions of these Terms which by their nature are intended to survive termination — including those relating to intellectual property, indemnity, limitation of liability, governing law, and any provision regarding the disclaimer of warranties — will continue in force after termination.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or business operations. The updated Terms will be posted on this page with a new “Last updated” date and take effect immediately on posting. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
16. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified only to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any provision of these Terms is not a waiver of that provision or our right to enforce it later.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia in respect of any dispute arising out of or in connection with these Terms or your use of the Site.
